Emissions Testing in New York

New York requires an annual vehicle inspection that includes both safety and emissions components for most registered vehicles statewide. The program is jointly administered by the New York State Department of Motor Vehicles (DMV) and the New York State Department of Environmental Conservation (DEC). The emissions program is called the New York Vehicle Inspection Program (NYVIP3). Inspections are performed at licensed Official Inspection Stations throughout the state. Most 1996 and newer gasoline vehicles and 1997 and newer diesel vehicles under 8,501 pounds receive an OBD-II emissions test. Vehicles in their first two model years and vehicles 25 model years and older are exempt from the emissions portion. Diesel vehicles over 8,500 pounds in the New York Metropolitan Area are subject to smoke opacity testing. All registered vehicles, including those exempt from emissions, must still pass the annual safety inspection. Drivers should confirm current requirements with the NY DMV at dmv.ny.gov.

Testing Requirements

Current Testing Requirements in New York

New York operates a statewide annual combined safety and emissions inspection program. The emissions component, NYVIP3, has been in effect since December 2023, incorporating OBD-II testing for light-duty vehicles and smoke opacity testing for heavy-duty diesels. The DEC oversees the emissions program, while the DMV manages the safety inspection and station licensing. Inspections are performed at licensed private Official Inspection Stations, identifiable by their black and yellow signs. The safety inspection covers brakes, steering, suspension, tires, lights, signals, windshield, wipers, mirrors, horn, seat belts, and exhaust system. The emissions portion for OBD-II-equipped vehicles checks for stored diagnostic trouble codes, readiness monitor status, and the malfunction indicator lamp. A gas cap check and visual inspection of emissions control devices are also performed on gasoline vehicles.

Who Needs a Vehicle Inspection

All registered motor vehicles in New York must pass an annual safety inspection. The OBD-II emissions inspection applies to most gasoline vehicles model year 1996 and newer and diesel vehicles model year 1997 and newer with a GVWR of 8,500 pounds or less. Vehicles in their first two model years are exempt from the emissions portion. Vehicles 25 model years and older are exempt from both OBD-II and low-enhanced emissions inspections. Electric vehicles, motorcycles, and vehicles with historic or farm registrations are exempt from emissions testing. Diesel vehicles over 8,500 pounds registered in the New York Metropolitan Area (the five boroughs of New York City, Nassau, Suffolk, Rockland, and Westchester counties) are subject to a separate smoke opacity test at Official Diesel Emission Inspection Stations. Gasoline vehicles between 8,501 and 18,000 pounds that are not OBD-II equipped receive a low-enhanced visual and gas cap inspection.

How Often Tests Are Required

Inspections are required annually. The inspection sticker expires on the last day of the month punched on it. An inspection is also required at change of ownership and when registering an out-of-state vehicle. Registration cannot be renewed without a passing inspection recorded in the DMV system within the previous 12 months. Drivers can inspect up to 90 days before the sticker expires without losing time on the new sticker period.

Where Emissions Testing Is Required

The OBD-II emissions inspection is required statewide for applicable vehicles. The enhanced smoke opacity test for heavy-duty diesel vehicles applies only in the New York Metropolitan Area (New York City, Nassau, Suffolk, Rockland, and Westchester counties). Upstate diesel vehicles over 8,500 pounds are exempt from the opacity test. The safety inspection is required statewide for all vehicles regardless of location.

What Happens During the Test

The safety inspection covers brakes (service and parking), steering, suspension, tires, lights, turn signals, windshield, wipers, mirrors, horn, seat belts, exhaust system, and fuel system. For OBD-II vehicles, the emissions portion takes about two minutes. The technician connects to the OBD-II port and checks the malfunction indicator lamp for operation and illumination, verifies that required readiness monitors have completed their self-checks, and scans for stored diagnostic trouble codes. A lit check engine light results in failure. A gas cap presence and condition check is performed on gasoline vehicles. A visual inspection confirms the presence and connection of emissions control devices. For heavy-duty diesels in the metro area, a smoke opacity test measures particulate emissions.

Areas in New York That Require Emissions Testing

The OBD-II emissions inspection is required statewide. Cities where inspections are available include New York City (Manhattan, Brooklyn, Queens, the Bronx, Staten Island), Buffalo, Rochester, Syracuse, Albany, Yonkers, New Rochelle, White Plains, Schenectady, Utica, Binghamton, Poughkeepsie, Ithaca, Saratoga Springs, Kingston, Plattsburgh, Watertown, Jamestown, Elmira, Niagara Falls, and Long Island communities including Hempstead, Babylon, Islip, Huntington, and Oyster Bay. The enhanced diesel opacity test applies only in the New York Metropolitan Area counties.

How the Vehicle Inspection Works in New York

Drivers take their vehicle to any licensed Official Inspection Station. These are private auto shops, dealerships, and service stations authorized by the DMV. Most stations accept walk-ins, though some accept appointments. If a station cannot inspect you immediately, it must offer an appointment within eight working days. Bring your vehicle registration. The state inspection fee for most passenger vehicles and light trucks is $10 for safety and $11 to $27 for emissions, depending on vehicle type, weight, and location. Vehicles in the New York Metropolitan Area pay $27 for the OBD-II emissions inspection. Outside the metro area, the OBD-II emissions fee is $11. Stations may also charge a service fee capped at $6. If the vehicle passes, it receives an inspection sticker valid for one year. If it fails, the station provides a Vehicle Inspection Report detailing the reasons. A reinspection fee applies if the vehicle returns within 10 days for items the station repaired. A repair expenditure waiver is available for vehicles that fail the OBD-II retest after qualifying emissions repairs totaling at least $450 in parts, labor, and tax. The waiver is valid for one year. Fines for expired stickers range from $25 to $50 if expired less than 60 days, and $50 to $100 if expired more than 60 days, plus a mandatory state surcharge.
